Patent is granted
for a technical invention which is new,
represent an adequate inventive achievement and
can be used in the
industries. Trademark is
governed by trademark law, which contains
rulings on trademarks acquired by use,
registered trademarks and protection of business
designations (company identification, such as
name, company name and work titles, e.g. films,
book). Utility model is a
property right for a technical invention, e.g.
for technical appliances, technical plants,
chemical substances, electrical circuits, etc.
Unlike a patent, utility model protection is not
possible for processes, such as production
processes, measurement procedures,
etc. Design patent does
protect the design of the color and shape of
two- or three- dimensional commercial products
which is intended to stimulate a person’s
aesthetic design sense by the mean of visual
